why "need help?" view sometimes not shown?

hi.
I'm using the liveHelperChat. It works correctly but sometimes "need help?" view does not shown in top of "status view".
why?

need help? is hidden if the user start a chat or close it and will be showed again after the time set by you in settings -> Misc.
I think the minimum time you can set is 1 hour.
